Personal Data Protection Notice (KVKK)
Pursuant to the Turkish Law on the Protection of Personal Data No. 6698 ("KVKK"), this notice explains how AVA Otomotiv Kimya processes your personal data.
2. Personal Data Processed
When you contact us through our website, we record your identity (name), contact details (email, phone), the subject of your request and the free-text content of your message. Our server logs also retain IP address, browser information and timestamp for technical purposes.
3. Purposes of Processing
Your data is processed for the following purposes: · Responding to your product, quote or technical information requests, · Evaluating distributor or partnership applications, · Maintaining communication continuity, · Fulfilling legal obligations (in subsequent contractual relationships, e.g. invoicing and accounting).
4. Legal Basis
Your data is processed under KVKK Art. 5: "processing is necessary for the legitimate interests of the data controller, provided that this processing does not violate the fundamental rights and freedoms of the data subject" and the establishment/performance of a contract. Your form submission is considered explicit consent.
5. Transfers
Your personal data is not sold to or shared with third parties for marketing without your explicit consent. Our contact-form provider Formspree (USA-based) processes the transfer to deliver your message to us; Formspree declares GDPR compliance. Transfers may be made to competent public authorities where required by law.
6. Retention Period
Contact requests are retained in our email archive for 12 months following resolution; for relationships that develop into contracts, statutory retention periods (Turkish Commercial Code, Tax Procedure Law) apply.
7. Your Rights
Under KVKK Art. 11, you have the right to: learn whether your personal data is processed; request information if it is; learn the purposes of processing; request correction if incomplete or incorrect; request erasure; learn the third parties to whom your data has been transferred; and demand erasure / destruction / anonymisation pursuant to KVKK Art. 7.
8. Application
To exercise your rights above, please write to info@avagrup.com with documents identifying you, or apply by post to our contact address. We will respond within 30 days at the latest. Applications made under the Communiqué on Procedures and Principles for Application to the Data Controller are processed free of charge.
